Many people are unaware that they may be entitled to an insurance payment, such as Total and Permanent Disability (‘TPD’), through their superannuation fund if they are unable to work due to injury or illness.

At Evolve Legal, our TPD team are experts in helping clients access these benefits and successfully navigate the claims process.

In this article, we outline a recent case success, where we assisted a former tradesperson who was diagnosed with heart failure in securing $400,000.00.

What are TPD benefits?

TPD benefits are an insurance benefit usually held through your superannuation, and are typically payable when you:

  1. Meet the eligibility criteria under your policy;
  2. Are suffering from an injury or illness; and
  3. Your injury or illness is preventing you from returning to work within your education, training or experience.

Our client’s TPD claim

In 2023, our client was forced to stop working after being diagnosed with a heart condition. Despite treatment, they continued to experience symptoms such as shortness of breath, dizziness, and chest tightness, which made it unlikely they could return to any work within their education, training or experience. Our client had only worked as a tradesperson throughout their working life and could no longer undertake these roles.

In late 2024, our client approached Evolve Legal. They were under significant financial strain at that time and were facing the prospect of losing their home.  After completing a free claims check, our team identified that our client was insured for $400,000.00 under a TPD policy held through their superannuation.

The team promptly reviewed the client’s insurance policy for any eligibility concerns and proceeded to gather comprehensive medical material to support the claim. The team understood the significant financial strain that the claimant was under and advocated for the claimant to have the claim assessed urgently.

The team also worked with the client’s mortgage provider and were able to secure a pause of their mortgage repayments while the claim was assessed. The claim was approved by the insurer within 8 weeks.

This outcome provided essential financial relief and allowed the claimant to meet their mortgage repayments and keep their family home. It also gave them the opportunity to proceed with long-awaited travel plans to visit their elderly parents.

This successful result highlights the importance of obtaining expert advice and strong legal advocacy in TPD claims.
